Terms and Conditions

Please read these SMS Terms and Conditions (the “SMS Terms”) carefully. By enrolling or otherwise agreeing to receive text messages from or on behalf of Lozano Insurance Adjusters and its subsidiaries (“Lozano” or “we”), or by otherwise providing your mobile telephone number to Lozano, you agree to these SMS Terms, as well as Lozano’s  Link to Privacy Policy, which are incorporated herein by reference and can be viewed at the links provided here,  Your consent to these SMS Terms is not required to purchase products, use services, or otherwise interact with Lozano, and you may opt out of SMS communications at any time. Message and data rates may apply, and message frequency varies.

Program Description

Lozano and its service providers may use an automatic telephone dialling system to deliver text messages to you. The text messages are intended to provide you with information about products and services, or to invite you to collaborate on projects, as applicable.

Opting into Text Messages

By opting into any Lozano program that utilizes texting to communicate with you, you are expressly consenting to receive recurring text messages that may be sent using an automatic telephone dialling system, by or on behalf of Lozano, to the mobile telephone number you provide us. By voluntarily providing your mobile telephone number to Lozano, you consent to receive transactional, operational, and/or informational text messages at that phone number. Please note that we may not be able to deliver messages to all mobile carriers. Consent to receive texts is not a condition of purchasing products, receiving services, or participating in programs. With your consent, you understand and agree that the text messages may be sent using automated technology.

How to Opt Out and Get Help

To stop receiving text messages from Lozano, you agree to reply STOP to the number sending the message. After replying STOP, you may receive additional communications confirming that your request has been received and processed, and you may continue to receive text messages for a short period while Lozano or its service providers process your request(s). If you opt out of one Lozano  text messaging program, you will remain opted into other Lozano text messaging programs (if applicable) unless you opt out of those programs separately. If you need further assistance, text HELP to the number sending the message and follow the instructions in the reply message, or contact Lozano using one of the options available at Lozanoadjusters.com. After opting out of receiving text messages, you may re-enroll in any Lozano text messaging program by following the instructions for that program.

Cost

Message and data rates may apply for any messages sent to you from or on behalf of Lozano, and messages you send to us. If you have any questions about your text plan or data plan, please contact your wireless provider.

Eligibility and Change in Phone Number

By opting into Loznao’s text messaging program(s) or by otherwise providing your mobile telephone number to Lozano, you warrant that you are 18 years of age or older. You further warrant that you are the current subscriber or authorized user of the phone number you have provided. You agree that you will not initiate messages to the mobile phone of any other person or entity without authorization. If you change, forfeit, or deactivate the phone number you have provided to Lozano, you agree to notify Lozano immediately. Mobile carriers are not liable for delayed or undelivered messages. You agree to indemnify Lozano in full for all liabilities, claims, damages, and expenses related to or caused in whole or in part by your failure to notify Lozano if you change your mobile telephone number, including but not limited to all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act (“TCPA”) and state telemarketing laws.

Access or Delivery to Mobile Network Is Not Guaranteed

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of the control of Lozano, and Lozano is not responsible or liable for issues arising from them.

Termination of Text Messaging

Lozano may suspend or terminate your receipt of Lozano text messages for any reason, including if Lozano believes you are in breach of these SMS Terms and Conditions. Your receipt of Lozano text messages is also subject to termination if your mobile telephone service terminates or lapses. Lozano reserves the right to modify or discontinue, temporarily or permanently, all or any part of Lozano text messages, with or without notice.

Changes to the SMS Terms

These SMS Terms may be updated by Lozano at any time without prior notice. By continuing to be enrolled in any Lozano text messaging program, or by providing your mobile telephone number for transactional, operational, or informational text messages, you agree to any changes.
